Graham ex rel. Graham v. Wyeth Laboratories (1987) Overview

The Graham family is suing Wyeth Laboratories for severe brain damage their daughter suffered after receiving a DPT vaccine. Wyeth argued that federal law preempts the plaintiffs' claims or that the vaccine is an "unavoidably unsafe" prescription drug. The court denied Wyeth's motion for summary judgment and determined that the case must proceed to trial. The plaintiffs argue that the vaccine could have been made safer. The case involves Wyeth's manufacture of the DPT vaccine, which is used to immunize children against diptheria, pertussis, and tetanus.
